By accepting the Terms of Use during the Kalkan Turkish Local News (KTLN) registration process you agree to be legally bound by these terms, which shall take effect immediately on your first use of KTLN.  If you do not agree to be legally bound by the following terms in their entirety you are not authorised to use KTLN and you should not access, use and/or contribute to KTLN.

From time to time we may change these Terms of Use.  Any such changes will be published on KTLN.  If you do not wish to agree to be legally bound by the amended Terms of Use in their entirety please do not continue to access, use and/or contribute to KTLN.

In accessing any part of KTLN, you agree:

• not to use this website in such a way that disrupts, interferes with or restricts the use of this website by other users;
• not to upload, display or transmit any materials through this website which are false, offensive, defamatory, threatening, obscene, unlawful or which infringe the rights of any other person anywhere in the world;
• not to reverse engineer, decompile, copy or adapt any software or other code or scripts forming part of this website or attempt to transmit to or via this website any information that contains a virus, worm, trojan horse or other harmful or disruptive component; and

Copyright in your contribution will remain with you and this permission is not exclusive, so you can continue to use the material in any way including allowing others to use it.

In order that KTLN can use your contribution, you confirm that your contribution is your own original work, is not defamatory and does not infringe any UK or Turkish laws, that you have the right to give KTLN permission to use it, and that you have the consent of anyone who is identifiable in your contribution or the consent of their parent / guardian if they are under 16.

We may show your name with your contribution, unless you request otherwise, but for operational reasons this is not always possible.  KTLN may need to contact you for administrative or verification purposes in relation to your contribution.

If you do not want to grant KTLN the permission set out above on these terms, please do not submit or share your contribution to, or with KTLN.

Third party material and classified advertisements
The KTLN website contains material (including but not limited to classified advertisements) submitted and created by third parties. All advertisements published in KTLN Classified Ads are subject to the Advertising Terms and Conditions detailed below.  All third party material is published by KTLN in good faith.  KTLN does not accept any responsibility for the accuracy of such material (nor is any warranty expressed or implied by publication) and KTLN specifically disclaims and excludes all liability to any person for any loss or damage of any nature whatsoever or however arising from any error, omission or inaccuracy in such material, and KTLN takes no responsibility for such material.

In the event that you purchase or obtain any goods or services from a third party then your acquisition of any such goods or services will be in accordance with the third party's terms and conditions and KTLN will have no liability to you in respect of the same.

All product names mentioned in KTLN Classified Ads are the trademarks of their respective owners.  Some documents may contain other proprietary notices and copyright information relating to that document or organisation.  You agree that KTLN has not conferred by implication, or otherwise, any licence or right under any patent, trademark or copyright (except as expressly provided) of KTLN or of any third party.
 
By submitting an advertisement to KTLN you automatically agree to be bound by the Advertising Terms and conditions.

All users are advised to check advert details carefully before entering into any agreements of any kind. If in doubt, please seek legal advice.

Classified Advertising Terms and Conditions
1. In these Advertising Terms and Conditions, "the Publisher" means Kalkan Turkish Local News (otherwise known as KTLN); "Seller" or "Advertiser" means the person placing the advertisement; "Buyer" means any person responding to an advertisement with an intention to buy; an 'Advertisement' means the matter to be published or separately inserted.

The publisher offers the service of publishing Advertisements on the KTLN website - www.turkishlocalnews.com.  These Advertising Terms and Conditions apply to Advertisements published on the KTLN website - www.turkishlocalnews.com.

The Seller's general obligations:
2. The Seller contracts with the Publisher as principal.

3. The Seller warrants that in relation to an Advertisement as submitted or subsequently amended:

    (a)   the reproduction and/or publication of such Advertisement will not breach any legislation, regulation (governmental or otherwise) or contract or infringe or violate any copyright, trademark, or other personal or proprietary right of any person or render the Publisher liable to any proceedings whatsoever;

    (b)   all advertising copy submitted to the Publisher is legal, decent, honest and truthful and complies with the British Code of Advertising Sales Promotion and Direct Marketing and all other relevant codes under the general supervision of the Advertising Standards Authority, OFCOM or any other applicable body.

4. The copyright for all purposes in all artwork, copy and other material which the Publisher has originated or reworked shall vest in the Publisher.  The Seller grants the Publisher a licence to reproduce on KTLN all material not so vesting unless specifically agreed otherwise.

5. The Seller will indemnify the Publisher and keep it indemnified against all claims, costs, proceedings, demands, losses, damages, expenses or liability whatsoever incurred by the Publisher arising directly or reasonably foreseeably as a result of any breach or non-performance by the seller of any of the representations, warranties or other terms herein contained or implied by law.

6. All material contained on the KTLN website is published in good faith, the Publisher does not in any circumstances accept responsibility for the accuracy or otherwise of any Advertisement or message published or its compliance with any legal or regulatory requirements (nor is any kind of warranty expressed or implied by such publication).  The Publisher specifically disclaims all and any liability to the Buyers, Advertisers, readers and users of any kind (other than death or personal injury caused by the Publisher's negligence or breach of statutory duty) for loss or damage of any nature whatsoever and however arising, whether due to inaccuracy, error, omission or any other cause, and whether on the part of the Publisher or its employees or agents or any other person.  Under no circumstances shall the Publisher be liable to the Buyer or the Advertiser or any other party for any special, incidental, indirect or consequential damages of any kind, including, without limitation, those resulting from loss of sales, loss of goodwill, loss of profits, whether or not the Publisher was advised of the possibility of such losses.  In all other respects, the Publisher's liability shall be limited to the placement of a new Advertisement the same or similar to the Advertisement originally placed on the KTLN website.

7. Where the Seller chooses to place an enhanced Advertisement, payment is due in advance of publication.  The Seller undertakes to make any such payment in accordance with the on screen instructions.  Any funds received by KTLN will be donated to The KTLN Trust.  KTLN will not make any deductions from any such funds received, however transaction fees may be deducted by PayPal.

8. The Publisher may decline to publish, or omit, suspend, edit, change the position or require amendment of all or any part of any Advertisement accepted for insertion. The Publisher is not obliged to publish any Advertisement on a particular day or in a particular position.

9. The Publisher will not be liable for any loss of copy, artwork, photographs or other materials.

10.  The Seller may cancel an Advertisement at any time.  Where an enhanced Advertisement has been published, any payment made is non-refundable.

Availability
Whilst KTLN will endeavour to ensure that the website is normally available 24 hours a day, we shall not be liable if for any reason the website is unavailable at any time or for any period.  Access to the KTLN website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control, such as a prolonged failure in the electricity supply.

Jurisdiction
This website has been designed and these terms of use shall be governed by and construed in accordance with English law. Any dispute arising out of the accessing or use of this website shall be subject to the jurisdiction of the English courts.

Additional terms for The KTLN Online Auction 2010

Please do not take part in the auction if you do not agree to be bound by them.

• The KTLN Trust is a UK based fund, with money raised going to a UK based bank account. All bids should be in British pounds please. If it is easier for you to pay in Turkish Lira, we can make arrangements to deal with your payment, but your bid should still be made in British pounds.  
• The auction ends at 9pm UK time, on Sunday 21st March 2010, according to the KTLN website clock. We suggest you get your bids in early and avoid last minute bids. KTLN won't enter into any correspondence about last second bids that did not make the cut off.
• Whilst the KTLN website server is pretty reliable, we can't give any 100% guarantees on availability.
• The highest bidder will receive the item, subject to payment being made within 7 days of being notified as the successful bidder. Details of how to pay are shown on The KTLN Trust donations page.
• All items must be taken up in 2010, but please note that some will only be available in the tourist season. For example, you can't take a boat trip in December.
• You will be expected to co-operate with KTLN and the donor business to provide reasonable notice of when you would like to take up the item you have successfully bid for.  If there are any additional, special conditions attached to an item, these will be shown in the description of the item.
• If you can't take up the item you have won, for any reason, there is no cash alternative.
• You may pass the item on to friends or family if you are personally unable to take up the item.
• You must agree to have your name (or your User Name on the KTLN website), published in a Local news article on KTLN, telling everyone who has won the auction items.
• KTLN will notify successful bidders through the email address we have in our records.
• KTLN provides no warranty or guarantee in respect of the items on offer.  You (the successful bidder), are making a voluntary donation to The KTLN Trust, and in return, a Kalkan business is donating an item to you.  No contract shall exist between you and KTLN.  
• KTLN will not be held responsible or liable for loss or damage of any nature whatsoever and however arising, including consequential loss, which may arise from you taking up the goods or services on offer.
• If you bid for an item you are signifying your acceptance of these terms and conditions.  If you do not accept these terms and conditions, please do not bid in the auction.
