Expats in Turkey with Intasure property insurance must take action PDF Print E-mail

Intasure sought advice from its Turkish lawyers and has now concluded that it cannot provide property insurance for expats who are resident in Turkey - i.e. people with an ikamet.

They will continue to provide insurance for people who reside in the UK and have a holiday home in Turkey.

This is the position outlined in correspondence we have seen from the company.  It is an interpretation that coincides with the view expressed in an official letter we have seen from a Turkish government official - namely that it is illegal for foreign residents to insure their Turkish property through Intasure.

The situation for unofficial expat residents - i.e. those who spend more than 6 months in Turkey, but don't possess an ikamet, is not clear. However, it may be risky to have a Intasure policy in this situation.

Apparently, there are 19 properties in Kaş and 108 in Kalkan, that are insured through Intasure. If one of those properties belongs to you, and you are an expat resident, you need to take action, and insure your property through a Turkish insurance company.

Today, Monday 18th October 2010, Mike Farley, the Managing Director of Intasure, provided Kalkan Turkish Local News with the following statement.

Turkish authorities have been in contact with some of our clients challenging the legitimacy of the Intasure policy sold to UK citizens who become Turkish residents.

At the inception of the policy Intasure’s understanding was that we complied with legal requirements. However, following advice from our Turkish lawyers who have been in contact with the authorities, Intasure have decided to withdraw from insuring property in Turkey owned by Turkish residents. We will continue to cover your property until renewal of your policy and advise you to seek cover from a local Turkish carrier at your renewal date.

For clarity we requested our Turkish lawyers advise us on the term "residents" and their response was as follows:

"According to tax regulations a person is a resident of Turkey if either;
(i) has a legal domicile in Turkey (the place in which you have intention to stay for an indefinite period) OR
(ii) has continuously stayed in Turkey more than six months in a given year."

UK / EU residents are unaffected by our decision to withdraw from insuring property owned by Turkish residents.
